How to buy

SALE TERMS:

The ability for a prospective buyer to enter into a contract via a "Standard Agreement of Sale" is solely determined by CheapTexasLand.com. All contracts are subject to being Void Where Prohibited. Pricing listed on CheapTexasLand.com takes precedence over pricing on any other listing site. No improvements requiring county permits can be undertaken until the property has been fully paid for and the deed has been recorded in the buyer’s name. The buyer agrees not to violate any state, county, or city ordinances related to the purchase of this property (including but not limited to residing on the property); any violation or citation issued by the State, County, HOA, etc., will result in the voiding of this contract, and all funds paid by the buyer shall be retained by the seller as damages, potentially leading to criminal and/or civil charges.

I understand that I am NOT permitted to occupy or reside on the property while making payments. However, I may camp or place an RV on the property, provided there are no county, state, or city ordinances prohibiting such usage.

CONDITIONS OF SALE:

• Buyers acknowledge that properties are sold in an "AS-IS" condition as of the sale date, subject to the physical condition and location of the parcel at the time of sale, along with all existing covenants, restrictions, reservations, exploration rights, easements, assessments, zoning regulations, and any other land use restrictions. All sales are considered FINAL. The seller will disclose all known facts about the property.

• Property information is deemed reliable but not guaranteed. Buyers are encouraged to conduct their own due diligence to their satisfaction.

• Buyers understand that no improvements requiring county permits can be made until the property is fully paid for, and the deed has been recorded in the buyer’s name.

• Due to the dynamic nature of the real estate market, properties are sold on a first-come, first-served basis and cannot be placed on hold. Once buyers have completed their due diligence and are ready to purchase a property, they may proceed with the down payment. However, if buyers decide not to retain the property or terminate the "Standard Agreement of Sale," the deposit, document fees, and any payments made are non-refundable. The "Standard Agreement of Sale" must be signed within 7 days of purchase or down payment will be retained by the seller as damages.

CODE VIOLATIONS:

• The buyer acknowledges that no improvements requiring county permits can be undertaken until the property is paid in full, and the deed has been recorded in the buyer’s name.

• The buyer agrees not to violate any state, county, or city ordinances pertaining to the purchase of the property (including but not limited to residing on the property). Any violation or citation issued by the county will result in the voiding of this contract, and all funds paid by the buyer shall be retained by the seller as damages.

• Permanent residence on the property while making payments is NOT permitted. If the parcel is not purchased outright, the buyer may not reside on the property while taking advantage of owner financing and making payments. Camping and RVs are permitted, provided there are no State, County, or City ordinances prohibiting this activity.

OWNER FINANCING:

For buyers opting for Owner Financing, CheapTexasLand.com employs a "Standard Agreement of Sale" or a "Land Contract." This document, also known as a contract for deed or agreement for deed, operates similarly to a note and mortgage. However, instead of the buyer immediately gaining title to the property, the seller retains title until the debt is fully repaid. Nonetheless, you hold the actual ownership rights and have owner privileges as outlined in our "Standard Agreement of Sale" contract.

Buyer(s) commit to making monthly payments to the Seller, as outlined in the "Standard Agreement of Sale," covering the principal amount, interest, and specified term, until the total amount is paid in full. The initial installment is due within 30 days as specified in the contract, with subsequent installments due on the same day each consecutive month until the debt is satisfied. Payments are applied first to fees, then to interest, and finally to the principal. In case of late payments exceeding 14 days, a late charge of 10% of the total monthly payment or a minimum of $10.00, whichever is greater, applies. Additionally, a service fee of $25.00 is applicable for any payment returned by the payer's bank.

There are no pre-payment penalties. Upon completion of payments or full payment, Seller will deliver a valid deed to the described property within Forty-Five days, or earlier at Seller’s discretion. If default occurs in making monthly installments and continues for ninety (90) days, Seller reserves the right to cancel this agreement without notice, retaining all payments made by Buyer(s) as damages. We strongly encourage you to make your payments in a timely manner.

Electronic Signatures Clause: To expedite the transaction, telecopied or emailed signatures may serve as substitutes for original signatures on this Amendment. Both Seller and Buyer affirm their intent to be legally bound by such signatures, acknowledging that the other party will rely on them. Furthermore, both parties waive any defenses concerning the enforcement of the terms based on telecopied or emailed signatures.

PROPERTY INSPECTION:

• It is strongly advised that buyers conduct thorough due diligence and inspect the property before making a purchase.

• All buyers should conduct a personal inspection of each property and assess its physical condition before making a purchase. Failure of a Buyer to obtain comprehensive information about the property's condition, or to conduct their own on-site or off-site property inspection and research, will not constitute grounds for any claim against the seller or the cancellation or adjustment of the sale.

SELLER AND WEBSITE DISCLAIMER:

It is the responsibility of the Buyer to verify the accuracy of all property measurements and specifications. Buyers are encouraged to contact the appropriate planning, zoning, and utility agencies to ensure the property meets their requirements before making a purchase.

PROPERTY TAXES / ASSOCIATION/ HOMEOWNER FEES:

• The Buyer assumes responsibility for all property taxes due after the sale date. Yearly County Taxes will be assessed as a fee included in the monthly payment.

• Similarly, Buyer is accountable for paying any applicable association fees, which will also be included in the monthly payment.

• Buyers should direct any inquiries regarding property taxes, assessed values, or supplemental assessments to the relevant county offices.

LOAN PRE-PAYMENT:

There is NO Loan Pre-Payment Penalty. Any loan can be settled at any time without incurring pre-payment fees.
